The terms that govern every order placed with Calvieri.

These terms govern your use of the Calvieri website and any purchase made through it. Please read them before ordering. Nothing here limits your statutory rights as a consumer.

1. Scope

   These terms apply to every order placed through calvieri.com. By placing an order you accept them.

   Our Refund & Return Policy, Shipping Policy and Privacy Policy form part of these terms. Where a conflict arises, the more specific policy prevails for the matter it governs.

   We do not accept any general terms or conditions you may seek to apply unless we have agreed to them in writing.

2. Eligibility

   You must be at least 18 years old and legally capable of entering into binding contracts to place an order.

   The shop is intended for consumers purchasing for personal use. We may refuse or limit orders that appear to be placed for commercial resale.

3. Orders and formation of contract

   Product listings are an invitation to treat, not a binding offer.

   Your order is an offer to purchase. We acknowledge receipt by email; this acknowledgement does not conclude the contract. The contract is formed when we send you a dispatch confirmation for the items concerned.

   Where an order contains several items, a separate contract arises for each item as it is dispatched.

   Before submitting your order you can review and correct input errors at the checkout summary screen. The contract is concluded in English and we retain the order text; you can access your order details through your account or your confirmation email.

4. Prices and VAT

   All prices are stated in euro (EUR) and include applicable value added tax. Standard delivery is free; any charges are shown before you confirm the order.

   For deliveries outside the European Union, import duties and local taxes may be levied by the destination country. These are not included in our prices, are set by your authorities, and are payable by the recipient.

   Where a reference price is shown struck through, it is the price at which the item was previously offered by Calvieri for a continuous period of at least 30 days, in accordance with Directive (EU) 2019/2161

5. Availability, pricing errors and refusal of orders

   All items are subject to availability. If an item becomes unavailable after you order, we will inform you and refund that item in full without undue delay.

   If a price or product description contains a manifest error, we are not obliged to supply at the incorrect price. We will contact you, and you may confirm at the corrected price or cancel for a full refund.

   We may refuse or cancel an order where there are reasonable grounds to suspect fraud, where delivery to your address is not possible, or where these terms have been breached. We will explain the reason and refund any amount paid.

6. Delivery

   Delivery times are estimates given in good faith and stated on our Shipping Policy.

   Where we fail to deliver within 30 days of the contract, or within any additional period you set, you may terminate the contract and receive a full refund, in accordance with Article 18 of Directive 2011/83/EU.

   You are responsible for providing an accurate and complete delivery address.

7. Right of withdrawal and returns

   Consumers in the European Union have a statutory right of withdrawal of 14 days. Calvieri additionally offers a voluntary 60-day return window with free return shipping.

   Both are set out in full, together with the model withdrawal form, in our Refund & Return Policy.

8. Legal guarantee of conformity

   Goods are covered by the two-year legal guarantee of conformity under Directive (EU) 2019/771. If goods do not conform to the contract you may require repair or replacement, or seek a proportionate price reduction or termination, in accordance with that Directive and your national law.

   This guarantee is free of charge and is not affected by any commercial guarantee we offer.

9. Accounts

   You are responsible for keeping your account credentials confidential and for activity carried out under your account. Tell us promptly if you suspect unauthorised use.

   We may suspend or close an account that is used in breach of these terms. You may close your account at any time by writing to support@calvieri.com.

10. Acceptable use

    You agree not to use the site to transmit unlawful or harmful material, to attempt unauthorised access to any system, to interfere with its operation, or to extract data by automated means without our written permission.

11. Intellectual property

    All content on this site — including the Calvieri name and marks, text, photography, layout and design — is owned by us or our licensors and protected by intellectual property law.

    You may view and print content for your own personal, non-commercial use. Any other reproduction, distribution or commercial use requires our prior written consent.

12. Liability

    We are liable for foreseeable loss or damage caused by our breach of these terms or our negligence.

    Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for breach of the legal guarantee of conformity, or for any other liability that cannot lawfully be excluded or limited.

    Subject to the paragraph above, we are not liable for loss that was not foreseeable at the time the contract was made, nor for loss of profit, business or opportunity arising from commercial use of the goods.

13. Force majeure

    We are not liable for delay or failure to perform caused by events beyond our reasonable control, including natural disasters, armed conflict, epidemics, industrial action, carrier failure, or interruption of utilities or telecommunications. Where such an event continues for more than [30] days, either party may terminate the affected contract and we will refund amounts paid for undelivered goods.

14. Governing law

    These terms are governed by the law of [PAIS DA SUA EMPRESA].

    If you are a consumer, this choice of law does not deprive you of the protection of the mandatory provisions of the law of the country in which you habitually reside, in accordance with Article 6 of Regulation (EC) No 593/2008 (Rome I). You may bring proceedings in the courts of your country of residence.

15. Complaints and dispute resolution

    Write first to support@calvieri.com. We acknowledge complaints within [48] hours and aim to resolve them within [14] days.

16. Changes to these terms

    We may amend these terms. The version in force at the moment you place an order is the version that governs that order. Changes are not applied retroactively to concluded contracts.
